Anderson Fire board to resume hearing investigation on Thursday

The board of the Anderson Fire Protection District will resume hearing the district investigation of management practices of the district in closed session on Thursday, June 25 at 6:30 p.m. Termed "a personnel matter concerning the Fire Chief," in the meeting agenda, Fire Chief Joe Piccinini has been on paid leave since the investigation began May 12.

In open session, the board will consider whether the district "should invite the Grand Jury to look into (the district's) activities, not because of any identified irregularities but to demonstrate its openness to public scrutiny and to improve District policies and procedures if the Grand Jury makes recommendations for changes," according to the meeting agenda.

Any action taken by the board in closed session would be announced immediately after the closed session meeting on Thursday.

Well, I see there is a large fire burning in Siskiyou County. I can only reiterate to the Fire Board-please put our Chief back to work. Fire season is here and we need him at the helm of the fire district.

I think there is also a lot of heat under the Fire Board as evidenced by their decision to 'invite' the Grand Jury into this investigation.

Could that be because Concerned Citizens have already requested such an investigation? Hmmm. Is part of the unholy trinity listening at last? Bet Comnick is not happy about that.

Knowing for certain that Purcell was not licensed to 'investigate' in California, perhaps they have finally started back pedaling a bit. How can the 'report' be used when it was illegally obtained?

Now about this 'open session' on Thursday. I thought such meetings had to be announced 72 hours ahead of time to give time for citizens of this community to hear about it and attend. Look at the time it was posted on this website. Interesting!! It should have been printed in tomorrow's valley post to be a legal announcement, shouldn't it?.

The "closed session" was announced at the last fire board meeting, but only as a closed session. There was no mention of an open meeting for the 25th at all. Are they hoping citizens will not attend? Interesting thought!

It has now been 6 weeks (yes, read my lips, 6 weeks of putting our fine fire Chief and his family through hell) since they began the premeditated mess with Chief, correct? You know, the meeting they went into with their minds already made up (Brown Act violation) to investigate the Chief and place him on administrative leave because Comnick was 'pithed' that Chief refused to give her friend Tom Brown a 'sign off' on the sprinkler system he did not want to pay for in his new building. That is only one thing on her long list.

But, oh, gosh, they forgot to check to see if Purcell (they already had him waiting in the wings) was actually a legally licensed investigator in the state of California. OOPS!!

Comnick's sidekicks were so brainwashed by her 'get the Chief out of here' idea that they forgot to 'ask the city council' for the use of a car, office, secretary, ride to and from the airport in the APD limo, etc. OOPS!!

They forgot to take into account the cost of 'last minute airfare'-if, indeed it was last minute, or did they already have those tickets purchased way ahead of time? (There is a way to check on that, you know) Add to that the cost of the Gaia Hotel, meals, 6 weeks of 'investigative'(I use the term loosely)costs....interesting. OOPS!!

Thinking they could quietly get rid of Chief, they were in for quite a shock when Concerned Citizens (a daily growing group as more and more people come and say 'count me in') began their own investigation, involving a recall and Grand Jury Investigation. OOPS!!

Darn those citizens for thinking for themselves that it is way past time to stop Comnick in her tracks. Darn them for finding out that Comnick tried to bribe the firefighters with dessert and campaign monies! OOPS!!

"We welcome a Grand Jury Investigation" stated Webster. OOPS!! Concerned Citizens thought of it first!! Neiner-neiner

Perhaps, just perhaps, this fire board is rethinking their position because how can they possibly have grounds to come against Chief with a flawed, illegal investigative report in their hot little hands. OOPS!!

Civil lawsuits by the dozens are bound to be in the wings, waiting to happen, should this fire board not back off from this whole orchestrated, embarrassing mess. I hope each of them has good insurance. OOPS!!

Has Comnick finally had to learn to pedal her tricycle backwards instead of riding it over good honest people she takes a dislike to for whatever reason?

At least 72 hours prior to each REGULAR meeting, legislative bodies must prepare an agenda containing a brief general description of each item to be transacted or discussed, including items which will be handled in closed session. (§ 54954.2(a) However, if I understand correctly the board did not adjourn from their last meeting and set a continuance to June 25th. However according to the Ralph M. Brown Act:

Regular and special meetings may be adjourned (continued) to a future date. (§ 54955.) If the subsequent meeting is conducted within FIVE (5) days of the original meeting, matters properly placed on the agenda for the original meeting may be considered at the subsequent meeting. (§54954.2(b)(3).) If the subsequent meeting is more than five (5) days from the original meeting,
a new agenda must be prepared and posted pursuant to section 54954.2.
More then five days have passed since the last meeting therefore a new agenda with a 72 hour notice is needed.
Furthermore, at least 72 hours prior to a regular meeting, an agenda must be posted which contains a brief general description of each item to be transacted or discussed at the meeting but notice must be received by all members of the body and by all media outlets that have requested notice in writing.

I do not feel the Anderson Valley Post received proper notification.

Furthermore the Ralph M. Brown Act concludes that the 72-hour notice requirement mandates local agencies to post their notices in locations which are accessible 24 hours a day for the 72 hours prior to the meeting. Accordingly, notices cannot be placed in buildings which are locked for some portion of the 72 hours immediately prior to the meeting. (78 Ops.Cal.Atty.Gen. 327, 331-332 (1995).

I can tell you the Fire Station does lock its office door after 5 PM.

Surely there is something that can be done to have an 'interim fire board' until elections happen. After all, surely there are plans in place just in case a fire board member(s) needs to be replaced immediately. Right?

2. The amount of Mr. Purcell’s flat fee for the investigation, if a flat fee is not being charged, please answer all items in number 3.
3. What are the following costs of Mr. Purcell’s charges?
a. Per day/per hour charge for his services
b. Per day per diem
c. Per day charge from the city of Anderson for vehicle use

f. Cost from the city of Anderson to pick up and drop off Mr. Purcell to Sacramento airport

5. Why was a local independent investigator not used?

1. Payment for services connected to the investigation of Chief Piccinini has not yet been made and upon presentation to the Board of invoice(s) pertaining to such services, those warrants will be reviewed for payment and be public documents.

2. There is no flat fee contract between the District and Mr. Purcell.

3. Total costs of the investigation have not been determined in that the investigation is not yet complete. Copies of invoices pertaining to the investigation are public records and will be made available when received by the District and presented to the Board for approval.

4. Item 4 of your request is construed to mean you are asking for a copy of any contract previously “in place” with Mr. Purcell. There is no such document or arrangement. There are no formal or informal bid documents for investigative services on file with the District.

5. With regard to items numbered 5 and 6, there are no documents on file with the District pertaining to contacts with other investigators.

6. The District is not in possession of any documents which you are referring to in item number 7 of your e-mail.

I agree that it is a violation of civil rights but isn't there an issue with the federal privacy act as well? It took a while but I read through the Privacy Act of 1974 and I'm not seeing where it says a company can give the personnel record of an individual to a private citizen. Not to mention that giving Chief's file to a citizen could open the Chief up to possible identity theft by anyone who may have had access to the file while it was in the possession of Purcell in a car or in the hotel. Please understand that I'm not calling anyone a thief or saying this happened; however, if the information is just sitting there, someone may have not resisted the urge and peeked. Chief Joe could have long term damage due to this illegal investigation.

Answer to number 2, it is not a flat fee.

No real answer to number 3, could it be the board has no idea how much Purcell is charging on a per day basis and the other charges incurred by him?

Answer to number 4, in gist, is that no formal bid process was conducted to select Purcell.

What do they mean the investigation is not yet complete? Didn't Webster say they were just waiting on the written report so they could make a decision? Didn't Purcell give the report orally 2 weeks ago? How can he give a report if the investigation isn't done? How can they make a decision tomorrow night if the investigation isn't done? How can they only be waiting on the written report if the investigation isn't done?

So, okay, extremely blunt question here....who's lying? Did Webster lie 2 weeks ago saying they were getting the oral report and awaiting the written report? Or, is Nichols lying here saying the investigation isn't done? Did Nichols make a big mistake in one of his first official documents as acting Chief? Please folks, at least get your stories straight!

Looks like one more inconsistency for a real investigation.

My gosh, let's just go out and do this investigation without any forethought. Let's just obey Comnick and "get the Chief." No wonder Anderson Voters voted overwhelmingly to have an elected Fire Board. This illegal activity has gone on far too long. Comnick thinks it up and Schaeffer and Webster just 'yes ma'am' her the whole time. Unholy trinity is too nice a name for these three.

It is a good thing this power trip is coming to a fast close. These people have had their illegal way in our community for too many years. I, for one, cannot wait to see this recall and Grand Jury Investigatio happen. Getting rid of this mess will bring a breath of fresh air to Anderson and its' citizens. We might actually see honest government in our town. Thankfully we have two untainted city council persons. We just need three more honest people who want to see Anderson flourish as it should.

Maybe if we all camp out on the sidewalk in front of her house, she will treat us to dessert, too. You think? Oh, I forgot, her bribes are only for the firefighters, who are being coerced by Fincher and Nichols to back the board or lose their jobs. Our group was busy tonight trust me but it wasn't at the meeting. Really, what was the point, so we could hear Bellinger rattle off the no confidence vote. We all know there is being pressure put on the volunteers to do what the Fire Board wants or else.

There is a firestorm of legalities that need to be addressed and will be, one way or another. It must be such a cross to bear to be as perfect in every way as the unholy trinity. Their good morals are a joke it seems to everyone but themselves. After the Chief's beating, who will be Norma's next victim?

Aren't we just so blessed to have such a perfect fire board with their perfect attorney and such a perfect acting fire chief? Oh yes, and some perfect Mamas going to bat for their perfect sons. How lucky we are to live in perfect Anderson. Sounds like Utopia. Except the real truth is stranger than fiction.

The unholy trinity continues to think that they are impervious(look that one up, HeardEnough)to any accountability at all.
Well, I have news for them. Enjoy your little playhouses while you can because the walls are about to fall down on your heads. Course, that might be a way to actually knock some sense into your heads---nnaaahhhh, you guys are too dense for anything to penetrate those thick skulls.

It is so amazing that this little unholy trinity group perceives those of us who are standing up for Chief as their latest enemies. They no longer speak or even acknowledge us when we meet in town, at meetings, etc. Isn't that strange? Because we differ in our opinions, we are now the enemy. Because we do not agree with them 100%, we are no longer worthy of even a glance in our direction. That is the way they play the game. Sounds like Russia to me. Of course, they are rather like the Gestapo.

So, once they are out of office, should we return the favor? Should we ostracize them? Hold them up to ridicule? No, we cannot do that, because they are already doing it to themselves. Anderson residents have watched this whole mess and taken note of exactly who is involved. Voters will soon show just how much power we have and how little power the unholy trinity has-which is much less than they think since they are legends in their own minds. (at least they would be if they had a mind)

By the way, Comnick, Schaeffer & Webster. Your village called, their idiots are missing. Go back where you belong, which is NOT in the Anderson political arena.
