Swerving around the City of Anderson's temporary moratorium on medical marijuana dispensaries, an Anderson entrepreneur said he hopes to open a delivery service Oct. 15.
"They're doing a moratorium on store fronts. They haven't addressed delivery services yet," business owner Jim Drake said. "It's for people too sick to go into stores (to) get their medicine. They do it in L.A. a lot. Anyone with a medical recommendation that needs cannabis, I'll be able to deliver it to them."
Regarding his supply of medical marijuana, Drake said he would investigate whether he could provide for customers from his own garden. However, Drake said he could not be precisely sure how he would run his business, as he must check with a lawyer prior to opening to ensure that all laws are obeyed.
Anderson's 90-day moratorium is set to end Oct. 21. Anderson City Manager Dana Shigley said staff will return to city council with a recommendation, probably on Oct. 6.
While indicating that the moratorium may not explicitly restrict a marijuana delivery service, Shigley said it was the city's intention that the moratorium cover such unexpected businesses.
"It's our intention that medical marijuana activities would be prohibited under current moratorium," Shigley said. "He (Drake) would need to request a specific interpretation from our city attorney."
With the Shasta County Board of Supervisors planning its own emergency moratorium Sept. 15, Shigley said cities and county agencies are getting together to come up with a consistent plan to make sure law enforcement is the same in all jurisdictions throughout the county.
