On Monday, Jan. 9, word was received from the city of Anderson’s legal council that the Green Heart collective had lost its appeal.
“My plans are to just continue to provide safe access even if it’s not out of the Anderson location,” said Gina Munday, who, along with husband Joe, owns the collective.
According to a memo issued by interim city manger John Blacklock on Jan. 13, the Court of Appeal advised the city that the dispensary’s petition and request for an immediate stay was denied and that there would be no need to file anything further with the court.
“The city will be following up to assure compliance with the court’s decision,” said Blacklock in the memo.
“I’ve removed the cannabis from the location for now,” said Munday. “It’s just unfortunate there was a ruling down in Riverside and so Judge Baker followed that. That ruling was submitted to the Supreme Court so we’re going to wait for the outcome to that.”
Munday indicated, however, that the store’s garden center would remain open.
“It’s only affecting the patients,” said Munday. “They are now going to have to scramble on how to get their medicine.”
Closure of the Green Heart follows the shutdown of other dispensaries in Shasta County. In Redding, a number of collectives are also awaiting the California Supreme Court’s decision.
“We still have a lawsuit against the city of Anderson,” said Munday, “and so we’re just kind of restructuring and we’ll see what happens down the road.”
In the meantime, Anderson police will continue to inspections to ensure compliance, although Chief of Police Shawn Watts indicated the Mundays had been very cooperative.
“Gina has told me we’re free to go in (to inspect the store),” said Watts.
