If it IS a fact that a person cannot LEGALLY consent to sex while in custody, I would hope that an officer, who is sworn to uphold the laws, would know this is a fact. So. Whether he was told that a fellow officer had sex with a woman under arrest and in custody or whether he was told that a fellow officer raped a woman under arrest and in custody, he should know that there is NO difference. The end result is still the same. Nonconsensual sex...AKA RAPE.

Then please have them look into the possibility of duplicity regarding the breathalyzer and its operator. They could start with interviewing those people arrested for DUI during nights when both Officer Goodwin and Benson worked.

It is not just the possibility of fudging the test results which concern me, but I have heard rumors of another sort. They can investigate and may turn up better information than 'rumors'.

In light of the allegations against the officers in Anderson, are you still confident in the DUI convictions with those two as the arresting officers?

Would you admit that it would take at least two or more officers in concert to be able to pull off a "fixed test?"

How often did those two officers work together?

Did their DUI or public intoxication arrests increase or reduce on those nights when they did work together?

How many of those arrests were women?

I think that any 10-year old child watching that (alleged) assault would be tramatized as we teach them to TRUST law enforcement and if they see one (allegedly) abusing their parent, that trust is broken but especially when there was NO REASON for it other than (allegedly) an overheard conversation where an officer confesses to a co-worker that he's "had a bad day."

My friend's (alleged) assault occurred on May 21. Now if she (allegedly) told jail personnel, such as, the booking agent, another officer bringing someone in to be booked, the medical professional who checked her as she arrived, the medical professional who checked her as she left as well as another inmate, you would think someone would have taken that complaint seriously. Instead, she was (allegedly) told by a medical professional in that jail that if she thought she was injured, she needed to check herself into the hospital. Now, if I were let out at 3am, I would also accept a ride from the fellow in-custody person who had funds for a taxi back to Anderson. I would chose to go home to my daughter. Why would I tell more people who aren't listening?

If someone had listened to these 'allegations', and even if ALL they did was slap the officer's hand, so to speak, at least that would let him know that he won't be getting away with that nor any other offenses against the citizens he is sworn to protect. We are watching.

But we weren't.

Eight days between May 21 and May 29.

Eight days between an alleged assault and an alleged rape.

Could a rape have been prevented?

I'm starting to look into the Civilian Review Board plus a few other things, like the ACLU. A friend says he can get me in touch with people there.

Did you know that there is no test to determine drunkenness when people are arrested for Public Intoxication? It is the officers word against the person arrested. Why is there no test? If you are drunk enough to be arrested, then there needs to be proof to back it up. Breathalyze them on site and at the jail.

How many of these people IN THE LAST MONTH were truly intoxicated enough to cause a danger to themselves or others and how many just had alcohol on their breath? We don't know and there is no rule requiring that the quantity be measured. If law enforcement feels like taking them in, they can and no one can say any different.

This article is lacking some very pertinent information. Define "excessive force" by detailing the nature of the allegation, or at least disclose the reason for the omission of truth.

AVP article said: "Captain Robert Kirvin... said the woman's complaint was not a criminal allegation."

Please know that I am aware that LE has the right to use excessive force in the line of duty. These lines, however, need to be more clearly drawn. The use of excessive force needs to be defined. When that line is crossed, LE should face assault charges with strict punishment and termination. LE should be held to a higher standard! It is time to start weeding out cops who abuse their power!

The incident in Seattle is a good example of police misconduct. This officer should be in jail. See for yourself, here is a link to the video.

I was wondering about that 'non-criminal' wordage too. For instance ... does that mean they get carte blanche powers while you are handcuffed to beat your face into the side of their patrol cars a few times or something? It's not like this is done in front of children or anything, right?

I would also like to know how seriously excessive force complaints are taken at Shasta County Jail. I'm liking more and more that Citizen's Review Board idea.
